JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-02-2019 Learned counsel for the petitioner submits that because of non-cooperation of the Executive Officer - cum - Block Development Officer, Tekari, Gaya the panchayat samiti has been rendered non-functional.

While learned counsel for the State prays for time to file a counter affidavit, learned counsel for the petitioner submits that he is not looking for any adjudication of dispute in this court and the petitioner has been compelled to move this court only because his complaint made to the authorities of the State are not being considered. The court has been informed that recently petitioner has represented before the Principal Secretary, Department of Panchayati Raj on 24.10.2018, a copy

Patna High Court CWJC No.1709 of 2019(2) dt.07-02-2019 2/2 of which has been placed at Annexure-7 to the writ application. In the given facts and circumstances, this court is of the considered opinion that without going into the merit of the writ application, it may be disposed of with a direction to the Principal Secretary of the Department to look into the grievance of the petitioner and take an appropriate decision thereon in accordance with law but after hearing all concerned who are likely to be effected by any order to be passed by the Principal Secretary.

It is expected that such a decision will be taken by the Principal Secretary, Panchayati Raj, Government of Bihar, Patna within a period of two months from the date of receipt/production of a copy of this order.
