JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-272 & 273 of the Indian Penal Code and 47 of Bihar Excise Amendment, Act 2016.
Twenty litres of Mahua liquor is said to have been recovered from joint possession of the petitioners, for which, the petitioners are languishing in jail custody since 14-07-2016. Petitioners do not have any criminal antecedent and claim of the petitioners is that they have falsely been implicated in this case by the police.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners
Patna High Court Cr.Misc. No.37367 of 2016 (2) dt.09-09-2016 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Sherghati P.S. Case No. 330 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
