The petitioner seeks regular bail in connection with Laraya Tand PS case no. 06 of 2018 registered for the offence punishable under Sections 147, 148, 149, 121, 121(A), 427, 435 of Indian Penal Code, 4/5 of Explosive Substance Act and Sections 18, 20, 22, 23 of UAP Act.

The allegation is regarding the accused persons including the petitioner having terrorized the village people by exploding bomb planted by the Naxali.

The learned counsel for the petitioner submits that bare perusal of the FIR will show that no case is made out against the petitioner and the petitioner has been falsely implicated in the present case. It is further submitted that though

No.5972 of 2019(2) dt.04-02-2019 2/2 the petitioner is an accused in three other cases but he is on bail in the said three cases and is ready to be imposed with such other conditions as may be imposed by this Court for grant of regular bail in the present case. It is further submitted that the petitioner is languishing in custody since 26.04.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Laraya Tand PS case no. 06 of 2018. It is further directed that the petitioner shall mark his presence before the officer-in-charge of the concerned police station at 10 am on every Monday and in case of failure to do so on two consecutive occasions, the present privilege of bail shall stand cancelled automatically.
