ANJANA MISHRA ORAL ORDER 26-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 24.11.2014 on surrender in connection with Forbesganj (Simraha) P.S. Case No.729 of 2014 registered for the offences under Sections 395 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that he is not named in the F.I.R. but, however, on the confessional statement of one Md. Anwar, petitioner's name has surfaced. Learned counsel for the petitioner submits that the allegation is that out of the looted money, the petitioner had purchased the motorcycle. Learned counsel further submits that save and except the confessional statement, there is no cogent material in the case

Patna High Court Cr.Misc. No.11679 of 2015 (3) dt.26-05-2015 2/2 diary to connect the petitioner with the present Bank dacoity and the allegations levelled against him cannot be sustained on the basis of the confessional statement. Learned counsel has produced a copy of the order dated 23.3.2015 passed in Cr.Misc. No.10515 of 2015, in which co-accused Chandan Kumar Rajbhar has been granted regular bail by a Bench of this Court. It is submitted that the petitioner's case stands on similar footing to that of Chandan Kumar Rajbhar. It is further submitted that the petitioner has not been put on T.I. Parade till date.

Considering the aforementioned submissions and the period of custody and also the fact that the petitioner's case stands on similar footing to that of co-accused Chandan Kumar Rajbhar, let the above named petitioner be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Forbesganj (Simraha) P.S. Case No.729 of 2014, G.R. No.3854 of 2014. (Anjana Mishra, J) PNM U T
