JUSTICE BIRENDRA KUMAR ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Daudnagar P.S. Case No.241 of 2013, a case under Sections 366A/376 of the Indian Penal Code and Section 4 of the POCSO Act.

The petitioner is in custody since 03.09.2013 having allegation that he ravished the daughter of the informant after abducting her. The victim had supported the allegation in the statement under Section 164 Cr.P.C.

Submission is that the matter is of love-affairs and under pressure of the parents; the victim had given such statement . The petitioner was earlier refused bail in Cr. Misc.

Patna High Court Cr.Misc. No.49732 of 2017 (4) dt.17-01-2018 P2/ No. 6124 of 2014, vide Annexure-1, with liberty to renew his prayer for bail after examination of the victim as prosecution witness. Uptil now no prosecution witness has been examined in this case.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
