The petitioner is accused in connection with Special Case No. 39 of 2014 arising out of Economic Offences P.S. Case No. 26 of 2014 registered under sections 8/20(B)(III)29 of Narcotics Drugs and psychotropic Substance Act pending in the Court of Additional Sessions Judge-VI, Patna. The accusation is of recovery of 232 kg. 100 grams Ganja from the truck.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is also submitted nothing has been recovered from the conscious possession of the petitioner. Further submission is

Patna High Court Cr.Misc. No.50838 of 2016 (4) dt.19-01-2017 2/2 that petitioner is in custody since 09.05.2016. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that the huge quantity of ganja was seized from the truck showing the involvement of the petitioner and the petitioner has no clean antecedent.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, prayer of the petitioner for bail is rejected.
