2. The petitioner apprehends his arrest in connection with Simari P.S. Case No. 337 of 2024, a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 35 litres of illicit country made mahua liquor has been recovered from the spot.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no concern with the alleged recovery. Alleged recovery is made from open place which is accessible to anyone.

5. Learned counsel for the State has opposed the

Patna High Court CR. MISC. No.2406 of 2025(2) dt.15-02-2025 2/2 prayer for bail of the petitioner and submits that petitioner has got three criminal antecedents of similar nature.

6. Considering the quantity of recovery and also three criminal antecedents of similar nature, this pre-arrest bail petition is dismissed.
