The petitioner seeks bail in connection with Parasi P.S. Case No. 65 of 2021 registered for the offence punishable under Section 366(A) of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 26.10.2021, charge-sheet has been submitted in the case and is a person with clean antecedent and the informant alleges that his minor daughter was kidnapped by the petitioner on 25.10.2021 for the purposes of marriage. The learned counsel submits that the victim was recovered, her statement was recorded under Section 164 of the Cr.P.C. as would be evident from Annexure-2 to the bail

Patna High Court CR. MISC. No.2352 of 2022(2) dt.25-05-2022 2/2 application and from perusal of the same it would manifest that she has not supported the prosecution case.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.10.2021, charge-sheet has been submitted in the case, is a person with clean antecedent and the victim has not supported the prosecution case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Parasi P.S. Case No. 65 of 2021.
