JUSTICE RAVI RANJAN ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 25 (1-B)a/26 of the Arms Act and Sections 30 (a), 38, 47 of Bihar Excise Amendment Act. It is contended that, as per allegation, 112 liters of foreign liquor were recovered from the car which was being driven by the petitioner. It is further contended that provision of Arms Act would not be applicable in the case of the petitioner as no firearm has been recovered from his possession. It is urged that the petitioner is in custody since 11.07.2017. It is claimed that his antecedent is clean.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)

Patna High Court Cr.Misc. No.46323 of 2017(2) dt.21-09-2017 2/2 with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 402 of 2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. However, one of the bailors must be belonging to the State of Bihar.
