Petitioner is in jail custody since 10.7.2014 in a case registered under section 302 of the Indian Penal Code. Admittedly, none has seen the actual killing of the deceased and dead body of the deceased was recovered from hut of the petitioner.

Learned counsel for the petitioner drew my attention towards para 14(ka) of the case diary and submitted that hut in question from which dead body is said to have been recovered was abandon and the petitioner was not residing in the hut since long. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate,
