The petitioner seeks regular bail in a case registered under Sections 386, 387 and other sections of the Indian Penal Code.
The informant alleged that on 14.09.2014 he parked his Bolero pick-up van, bearing registration no. JH-12C/2128, at Bihat Chandani Chawk. One person came and asked him to carry sacks of gram from Ganga Sarai to Begusarai and thereafter the informant went along with him to Ganga Sarai, P.S. Barhaiya, District Lakhisarai. The petitioner along with 3-4 persons was sitting there. The petitioner asked the informant to pay extortion of rupees two lakhs. The informant returned on the next day but his vehicle could not be released. It is submitted that the occurrence took place on 14.09.2014 but the F.I.R. was lodged on 01.10.2014.
Patna High Court Cr.Misc. No.10447 of 2015 (3) dt.19-05-2015 2/2 The petitioner is in jail since 02.10.2014. It appears that the F.I.R. was lodged after 16 days of the occurrence. The petitioner has already remained in jail for more than eight months. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Barauni (F.C.I) P.S. Case No. 412 of 2014.
