The present petition has been filed for quashing the order of suspension dated 12.12.2019, which has been passed from a retrospective date i.e. w.e.f. 12.10.2019, under Rule 9(1) (a & c) and Rule 9(2) of the Bihar C.C.A. Rules, 2005. The learned counsel for the petitioner has raised various issues and has also relied on a judgment of a coordinate Bench of this Court dated 02.11.2012 passed in CWJC No. 16504 of 2012 (Ranjan Kumar Chauhan vs. The State of Bihar & Ors.). The learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the

Patna High Court CWJC No.618 of 2020(8) dt.01-03-2021 2/2 aforesaid judgment, nonetheless, the petitioner would be approaching the Principal Secretary, General Administration Department, Government of Bihar, Patna for pointing out the wrong committed by the respondents.

Accordingly, the present writ petition stands disposed of with liberty to the petitioner to file representation before the Principal Secretary, General Administration Department, Government of Bihar, Patna regarding his aforesaid grievances and in case such a representation is filed within a period of two weeks from today, the same shall be disposed of by a reasoned and a speaking, in accordance with law, considering the aforesaid judgment rendered in the case of Ranjan Kumar Chauhan (supra), within a period of four weeks, thereafter.
