Learned counsel for the petitioner submits that the present writ petition has been filed with the following reliefs:- (i) To issue appropriate direction, order or writ in the nature of Certiorari quashing the memo of charges issued by the Commandant, Bihar Special Armed Police (Women), Sasaram as contained in memo no. 174 dated 17.01.2023 (Annexure-P/5) by which departmental proceeding

Patna High Court CWJC No.465 of 2024(4) dt.24-07-2026 2/3 has been initiated against the petitioner on the basis of erroneous enquiry report of the Deputy Superintendent of Police, Bihar Special Armed Police (Women), Sasaram only with a view to deprive the petitioner of long awaited promotion. (ii) To issue appropriate direction, order or writ in the nature of Certiorari quashing the preliminary enquiry report of the Deputy Superintendent of Police, Bihar Special Armed Police (Women), Sasaram as contained in letter no. 3708 dated 13.12.2022 (Annexure-P/2) by which the petitioner has wrongly been held guilty for not giving information of irregularity in time.

(iii) To issue appropriate direction, order or writ in the nature of Certiorari quashing the entire departmental proceeding pending against the petitioner vide Enquiry No. 08/2023.

Learned counsel for the petitioner submits that according to his information, the departmental inquiry has been acquitted, but neither report nor second show-cause has been provided to him nor any final order has been passed. He further submits that the respondent authorities are making intentional delay so that the petitioner may not be promoted as his service is left for one year only.

4. Learned counsel for the State has raised preliminary objection and submits that there is no delay on the part of the respondent authorities. He further submits that the

5. In the light of the submissions made, this Court hereby directs to the Commandant, Bihar Special Armed Police (Women), Sasaram, (Respondent No.6) to conclude the departmental proceeding within 45 days from the date of production of the order as counsel for the petitioner has mentioned that the inquiry proceeding has already been completed.

6. It is made clear that if the said proceeding shall not be ended within the said 45 days, then Respondent No.6 shall be under contempt.
