JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-04-2015 Petitioner is languishing in custody since 28.08.2014 in a case registered for the offences punishable under Sections 406, 420 of the I.P.C and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

It is alleged that villagers formed an association namely Jan Chetna Swayam Sahayata Samooh in which every member used to deposit Rs. 100/-. Subsequently the Chairman Paltan Mahto, Treasury officer Jagdish Mahto and this petitioner being Secretary of the association withdrew Rs. 5,00,000/- and when the informant enquired about the deposits being withdrawn by them then the informant was abused by calling caste name.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. There is no proof with regard to the withdrawal.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that investigation has already concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Special Judge, Samastipur in connection with Sessions Trial No. 24 of 2015, arising out of Kalayanpur P.S.
