JUSTICE SUDHIR SINGH ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are languishing in custody since 15.04.2017 in connection with Sono P.S. Case No. 174/2016 for the offences instituted under Sections 341, 342, 498(A), 506/34 of the IPC. Later on, Section 304(B) of the IPC was also added. The prosecution story, in brief, is that the accused persons including the petitioners killed the informant due to nonfulfilment of demand of dowry. It has been submitted on behalf of the petitioners that the petitioners are in custody since 15.04.2017 and the charge sheet has been submitted in the present case. There is no allegation of

Patna High Court Cr.Misc. No.33704 of 2017 (3) dt.10-08-2017 2/2 tampering of the witnesses alleged against the petitioners. The petitioners are in-laws of the informant-deceased. They are separate in mess and property from the husband of the deceased. In course of investigation, the father and the mother of the deceased have not supported the prosecution case. The death has taken place due to accidental fire. They have got no criminal antecedent.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui, in connection with Sono P.S.
