The petitioner seeks regular bail in Araria (Mahila) P.S. Case No. 66/2018, registered for the offences punishable under Sections 341, 323, 376, 504, 506 and 34 of the Indian Penal Code.
Informant is a married lady. She has stated in her written application that she was married about nine years ago with Victor Yadav. Out of the aforesaid wedlock two sons were born. Mental condition of her husband was not good, therefore, she was living in her parents house. About two and half years ago the informant met with this petitioner. He used to come in her parents house. Petitioner established physical relation with the informant and thereafter they continued to establish physical

No.3503 of 2019(2) dt.01-02-2019 2/2 relation on the pretext that the petitioner will perform marriage with her and ultimately she got pregnant, but petitioner refused to marry her and the informant gave birth to a child, but the petitioner is not ready to accept that child. Learned counsel for the petitioner has submitted that from the written report itself it will be apparent that physical relation was established about two and half years back and the same continued on account of which informant became pregnant. The conduct of informant does not show that any rape was committed with her rather it was a consensual relationship. Petitioner is in custody since 27.07.2018 having clean antecedent.
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria (Mahila) P.S. Case No. 66/2018, subject to the condition that both the bailors will be close relative of the petitioner.
