The petitioner apprehends his arrest in connection with Bettiah Muffasil P.S. Case No.94 of 2021, registered for the offence punishable under sections 379, 411 of the Indian Penal Code.

The allegation against the petitioner is that he is involved in the theft of motorcycle of the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. He submits that the petitioner is not named in the FIR but during the investigation one co-accused namely, Raja Kumar was apprehended by the

Patna High Court CR. MISC. No.3709 of 2023(2) dt.10-02-2023 2/2 police and he disclosed the name of the petitioner. He further submits that no recovery has been made from the conscious possession of the petitioner. Petitioner has one criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. Accordingly, this application is dismissed.
