20-03-2020 Heard learned counsel for the parties.

The petitioner seeks bail in Nasriganj P.S. Case No. 231 of 2018 (G.R. No. 1243 of 2018) registered for the offence under Sections 409, 420, 120(B) & 34 of the Indian Penal Code. As per F.I.R., the petitioner, as Ward Secretary, alongwith co-accused Dhankeshwar Singh, Chairman of the Managing Committee of Ward No. 14 had withdrawn Rs. 60,64,000/- (sixty lacs & sixty four thousand) for the scheme of 'Mukhyamantri Gramin Peyjal Nischay and Gali Nali Yojna' from the Bank. On verification, it was found that work of Rs. 25,79,214/- was accomplished, but rest of the amount has been misappropriated by them, in connivance with other accused persons.

It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. There is no specific

Patna High Court CR. MISC. No.3234 of 2020(3) dt.20-03-2020 2/2 allegation attributed against the petitioner. It is further submitted that co-accused Maya Devi and Sunil Singh have already been granted bail by this Court, vide order dated 12-06-2019 and 07-08-2019 passed in Cr.Misc. No. 36301 of 2019 and Cr.Misc. No. 49505 of 2019 respectively, whereas, Chairman of the Managing Committed namely Dhankeshwar Singh has been extended the privilege of anticipatory bail by this Court, vide order dated 28-06-2019 passed in Cr.Misc. No. 20202 of 2019. Petitioner is in custody since 05-11-2019, having no criminal antecedent. In this case, chargesheet has already been submitted and as such, there is no chance of tampering with the evidence.

Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 231 of 2018, G.R. No. 1243 of 2018.
