The petitioner is languishing in custody since 04.10.2014 in a case registered for the offences punishable under Sections 324 and 307 of the Indian Penal Code.
The accusation against the petitioner is of causing grievous injury with knife to Vijay Sah. It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow hence, the case does not come within the purview of Section 307 of the I.P.C. and the informant has retracted from his initial version and filed a petition to that effect before the learned court below, the same has been brought on record as Annexure-2. Patna High Court Cr.Misc. No.9183 of 2015 (2) dt.13-03-2015 2 / 2 no. 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champaran, in connection with Chhauradano P.S. Case No. 105 of 2014.
