2. The petitioner is apprehending his arrest in connection with Forbesganj P.S. Case No. 281 of 2025 for the offence under sections 316(5) and 318(4) of the BNS lodged on 06.06.2025 by the informant, Md. Jahangir Alam.

3. As per the prosecution story, the informant alleged that the petitioner while posted as Sub-Post Master at Forbesganj misappropriated a sum of Rs. 9,91,634 which was accepted by him in writing that the said amount is not available in the Sub Post Office. This led to the FIR.

4. With the help of paragraph no. 9, learned counsel for the petitioner submits that the amount in question (Rs.

Patna High Court CR. MISC. No.1131 of 2026(2) dt.04-02-2026 2/3 9,91,634) has been deposited in the amount of Sub Post Office, SR Forbesganj and the receipt dated 05.08.2025 has been annexed as annexure-P/2 to the petition.

5. Learned APP opposes the prayer submitting that allegation of misappropriation is there.

Taking into account the submissions of the parties as also that the petitioner has no criminal antecedent, FIR is there, he shall be facing the music and the amount in question has been deposited, in that background, this Court is inclined to extend him the privilege of anticipatory bail with conditions.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 281 of 2025 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document (Aadhaar Card/Voter ID Card/Pan Card/Driving License) to show his/her bona fide;

(ii) the petitioner shall appear on each and every date

Patna High Court CR. MISC. No.1131 of 2026(2) dt.04-02-2026 3/3 before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
