JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-03-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

As per prosecution, it is alleged that while the informant along with his friend was going from the bank after withdrawing Rs. 98,000/-, four miscreants intercepted them and on the point of arms, they looted away cash of Rs. 98,000/-.

Nothing has been recovered from the conscious possession of the petitioner. The petitioner is languishing in custody since 18.02.2021. Moreover, similarly situated co-accused has been granted privilege of bail by a coordinate Bench of this Court vide order dated 11.04.2022 passed in Cr. Misc. No. 59286 of 2021. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IX, Bettiah, West Champaran in connection with Lauriya P.S.
