JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Phulwaria P.S. Case No. 138 of 2016 registered under Sections 366(A)/120(B)/34 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that this is a case of love affairs. In fact, the victim herself filed a petition in the Trial Court on 23.09.2016, as contained in Annexure-2, stating therein that she, aged about 20 years, leaved her house according to her sweet will and married with this petitioner in a temple and living with this petitioner as wife and husband. She also stated that petitioner has falsely been implicated in this case by her father and one Bhairwanand Rai in the case of kidnapping. Further submission is that the Doctor assessed her age

Patna High Court Cr.Misc. No.677 of 2017 (2) dt.12-01-2017 2/2 in between 20-22 years and no any injury is found on her body. Petitioner is in custody since 24.09.2016, having no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Begusarai in connection with Phulwaria P.S. Case No. 138 of 2016.
