JUSTICE MADHURESH PRASAD ORAL ORDER 12-09-2022 Counsel for the petitioner submits that in view of the stand taken in paragraph 18 of the counter affidavit, he will be filing a proper appeal. Since considerable time has lapsed during pendency of the instant proceedings, he submits that the petitioner's appeal be considered by the authority, without raising any issue of delay.

The State Counsel has appeared. He has submitted that no appeal has been filed by the petitioner. Considering the rival submissions, having regarding to objection in the counter affidavit regarding Annexures 12 and
