Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Sasaram (M) P.S. Case No. 114 of 2021 registered for the offence punishable under Sections 147, 341, 323, 307, 447, 504 and 325 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was also added.
As per the prosecution case, a 65 years old person was assaulted by the petitioners and head injury was caused upon him, as a result of which he died. The petitioners and
Patna High Court CR. MISC. No.1981 of 2022(2) dt.22-03-2022 2/2 deceased are closely related.
It has been contended by learned counsel for the petitioner that because of land dispute the fight took place and the occurrence was not intentional.
Mere pendency of land dispute does not give license to the petitioners to kill a man.
Considering the aforesaid facts, in the opinion of this Court, this is not a fit case for grant of anticipatory bail to the petitioners. Accordingly, this anticipatory bail application is dismissed.
