Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 304(B) and 201/34 of the Indian Penal Code. The allegation against the petitioner is of killing the daughter of the informant for non fulfillment of demand of dowry. It is submitted on behalf of the petitioner that the petitioner is in custody since 10.02.2015. Five prosecution witnesses including the informant have been examined in course of trial. The deposition of the witnesses including that of the informant has been brought on record by way of filing of a
Patna High Court Cr.Misc. No.23960 of 2016 (5) dt.16-08-2016 2/2 supplementary affidavit. All the witnesses have been declared hostile including the informant.
On behalf of the State it has been submitted that the prosecution witnesses including the informant have been declared hostile in course of trial.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge- VIth at Gaya in connection with S.Trial No. 29 of 2015 arising out of Koach P.S.Case No.221 of 2013.
