The petitioner seeks regular bail in connection with GO Case No.1199 of 2019 arising out of Bahera PS Case No.477/19 registered for offences punishable under Sections 30(a), 32(3), 41(1) of the Bihar Prohibition and Excise Act, 2016 . Allegation against the petitioner is about recovery of 14 ltrs. of liquor from the house of the petitioner. Submission of the learned counsel for the petitioner is that recovery is from the abundant house and he is not residing there as well as having no criminal antecedent and he is in custody for 23.11.2019 months. There is no chance of tampering with the evidence at the hands of the petitioner. Heard learned A.P.P. also.

Sessions Judge cum Special Judge Excise, Darbhanga in connection with G.O. Case No.1199 of 2019 arising out of Bahera P.S.Case NO.477/19..

With the aforesaid observation, this application is allowed.
