Public Prosecutor for the State assisted by learned counsel for the informant.

Petitioner is in jail custody since 23.8.2014 in a murder case of two persons and it is alleged that he opened fire on leg of the deceased Jawahar Gupta.

Learned counsel for the petitioner drew my attention towards the post mortem report of the deceased Jawahar Gupta and submitted that no doubt, one injury has been found on the thigh of the deceased but doctor found only abrasion on left thigh lateral side above knee joint of the deceased. It is further contended by him that there was land dispute between the parties and after investigation, charge sheet has already been submitted against the petitioner. Petitioner does not have any criminal antecedent and appears to be a student.

Patna High Court Cr.Misc. No.16524 of 2015 (3) dt.03-07-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Ankur Gupta, Judicial Magistrate, Ist Class, Khagaria/concerned court in Chautham P.S. Case no. 103/2014.
