JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-08-2021 Heard the parties through virtual Court proceedings. The petitioner has moved for regular bail in a case registered for the offence punishable under Sections 135 of the Custom Act and Violation of Notification no. 23/1999 dated 13.04.1999.
In pursuance to the order dated 14.07.2021, a report was called for regarding the stage of trial and the time likely to be taken in conclusion of the trial. I perused the report, has been transmitted by the learned Court below, which is kept at Flag 'R', which suggests that four charge-sheet witnesses have been examined, he may be disposed of the present bail application
Patna High Court CR. MISC. No.14758 of 2021(4) dt.04-08-20 assuming 21 2/2 within six months.
Considering the report of the trial court, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail is rejected in connection with Custom P.S. Case No.112/2018 pending before the learned court of Presiding Officer, Special Court, Economics Offence, Muzaffarpur, Bihar. Accordingly, this application is dismissed. However, the trial court is directed to conclude the trial within six months from the date of initiation of normal physical proceeding and / or through Video conferencing.
