2. The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 366(A), 506 of the Indian Penal Code and Sections 8, 12 of the POCSO Act.

3. As per the prosecution case, this petitioner kidnapped the minor daughter of informant.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Petitioner has not kidnapped the daughter of informant. In fact, there was love affairs between this petitioner and the victim. In the statement recorded under Section 164 Cr.P.C., the victim herself has stated that she, with her own sweet will, had left the house and went to Ambala with this petitioner and lived there with him in a rented home, but after knowing the fact of lodging the aforesaid case, she came from there. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VII cum Special Judge, POCSO, West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 812 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
