The petitioners seek pre-arrest bail in connection with Rajpur P. S. Case No.165 of 2017 registered under Sections 147, 148, 341, 323, 353 and 506 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that similarly circumstanced co-accused have already been granted pre-arrest bail, vide order dated 22.08.2017, passed in Cr. Misc. No. 39522 of 2017 by a coordinate Bench of this Court.
Patna High Court Cr.Misc. No.41737 of 2017 (2) dt.20-09-2017 2/2 Regard being had to the allegation that a large number of persons including the petitioner raised protest against the administration demanding electric connection for their village and no one had sustained any injury in the alleged occurrence as also the fact that other co-accused persons have already been granted pre-arrest bail by a co-ordinate Bench of this Court, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Buxar in Rajpur P. S. Case No.165 of 2017, subject to the conditions as laid down under Section 438
