The petitioner apprehends his arrest in a case registered for the offence under Section 272, 273, 34 of I.P.C. and Section 30(a) of the Bihar Prohibition & Excise Act. 90 liters of country-made liquor has been recovered from a pick-up van.

It is submitted on behalf of petitioner that nothing has been recovered from the possession of this petitioner and has got no concern with the alleged recovery. Petitioner has been made accused in this case only on suspicion.

However, learned A.P.P. for the State vehemently opposed the prayer for bail and submitted that petitioner has got one criminal antecedent of similar nature.
