Petitioner was Panchayat Secretary at the relevant time and the accusation against him is that he took advance for execution of several government schemes but did not complete the work and digested the entire government money. The contention on behalf of petitioner is that the petitioner is languishing in jail custody since 19-05-2014 and as a matter of fact, petitioner did almost all the work, allotted to him but due to his detention, he is not in a position to explain his stand before the concerned authorities. Further contention of the petitioner is that the detention of the petitioner in the period of trial is not required as there is nothing on record to show that the
Patna High Court Cr.Misc. No.15797 of 2015 (3) dt.10-09-2015 2/2 release of the petitioner on bail, shall tamper the prosecution case. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bhagwanpur P.S.
