JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2017 The petitioner seeks bail in connection with Bhabua P.S. Case No. 533 of 2011 registered for offences punishable under sections 420, 409, 467, 468, 471/34 of the Indian Penal Code and 120B of the I.P.C. Section 13(1)(d) of the Prevention of Corruption Act.

Allegation as per FIR is that the Audit Report of State Health Society shows that there were irregularities of Rs.5.50 crores and payment was made to the petitioner, who is running the N.G.O., to the tune of Rs.3,76,500/-.

Learned counsel for the petitioner submitted that the petitioner has earlier deposited total amount with the permission of the Court and he is in custody for about two months. Heard learned P.P. also.

Learned counsel for the Vigilance admitted the fact that

Having heard both sides and considering the aforementioned facts and circumstances, let petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance-1st, Patna in Bhabua P.S. Case No. 533 of 2011, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not adduce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
