2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 307, 379, 354, 504, 506/34 of the Indian Penal Code.
3. As per F.I.R., petitioner no. 2 gave axe blow on the head of informant, which is grievous in nature, whereas petitioner no. 1 assaulted with lathi to the informant.
4. It is submitted on behalf of petitioners that there is case and counter case and both sides sustained injuries. Petitioners claim clean antecedent.
5. Considering the fact that the injury caused by
Patna High Court CR. MISC. No.4249 of 2024(3) dt.07-03-2024 2/2 petitioner no. 2 namely Md. Nahid Anwar has been found to be grievous in nature, his prayer for anticipatory bail is rejected.
6. So far as prayer for anticipatory bail of petitioner no.1 namely Md. Abullais @ Abullais, is concerned, in the event of his arrest/surrender within a period of six weeks from today, he is directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Sadar P.S. Case No. 782 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
