The case is under Sections 364 and 302 Indian Penal Code and the petitioner was named in the FIR. The deceased happened to be the brother of the informant who had left his house in the company of the petitioner and others by his motorcycle. The informant after some times failed to contact his brother as his two cellular phones were found switched off. Initially, a missing report was lodged which was subsequently converted into a fullfledged crime report. During the course of investigation, this petitioner Ratan Sah appears leading the police to recover a variety of articles including Kinetic Honda motorcycle bearing registration no.JH11B-1698 which was used allegedly in commission of the offence

Patna High Court Cr.Misc. No.14602 of 2015 (3) dt.29-07-2015 from the possession of co-accused Bijay Kumar Singh. The other articles which were recovered were two looking glasses of the motorcycle which were also recovered at the behest of the present petitioner, considering which, the prayer is dismissed in connection with Kasim Bazar P.S.Case No.150 of 2014 pending in the Court of Judicial Magistrate, Ist Class, Munger.
