The petitioner was initially appointed as a Compiler by the Directorate of Statistics and Evaluation, Department of Planning, State of Bihar, Patna pursuant to the recommendation of the Bihar State Subordinate Service Selection Board. After about seven years of his appointment on the aforesaid post, he was dismissed from service on the ground of his being an imposter and not the correct person who had appeared before the Selection Board. No. 4684 of 1999 set aside the aforesaid order of dismissal of the petitioner on the ground of his being the imposter. Later, by order dated 31.10.2012 passed by a Bench of this Court in C.W.J.C. No. 11440 of 2007, the respondents were directed to treat the petitioner to have been reinstated in service with effect from the date of his dismissal with all consequential benefits including continuity of service and pay. By the aforesaid order of this Court, it was held that it would be the responsibility of the Director to ensure the compliance of the content of the order within a period of two months of the passing of that order. Pursuant to the aforesaid order, the petitioner was given all the benefits and was also accorded continuity in service.

However, later, juniors to the petitioner have been posted as Junior Statistics Supervisor and the petitioner has been placed below them in the gradation list.

Under the aforesaid circumstances, the petitioner is directed to file a fresh representation before the Director, Directorate of Economic and Statistics, State of Bihar, Patna within a period of four weeks from today. On such representation by the petitioner, the Director shall dispose it off within a period of six weeks thereafter. With the aforesaid observation / direction, this writ petition stands disposed off.
