The petitioner seeks regular bail in connection with Ahiyapur PS case no. 1166 of 2018 registered for the offence punishable under Sections 394 of Indian Penal Code and 27 of Arms Act.
The allegation is regarding unknown miscreants having intercepted the motorcycle of the informant and snatched his bag containing medicine and cash amounting to Rs. 19500/-. The learned counsel for the petitioner submits that the petitioner is innocent, he has been falsely implicated in the present case and infact, neither any recovery has been made from his possession nor any test identification parade has been held. It is further submitted that the petitioner was apprehended
Patna High Court Cr.Misc. No.4884 of 2019(2) dt.29-01-2019 2/2 in another case bearing Ahiyapur PS case no. 1172 of 2018 and thereafter, he has been remanded in the present case without any basis. The petitioner is said to be languishing in custody since 24.11.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Muzaffarpur in connection with Ahiyapur PS case no. 1166 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
