Petitioner is not named in the first information report and from perusal of the impugned order of the learned Sessions Judge, it would appear that looted sugar was recovered on the basis of confessional statement made by co-accused Kishore Prasad whereas looted tractor was recovered on the basis of confessional statement of Subrati Mian and so far as the petitioner is concerned, it appears that except confessional statement of Subrati Mian, there is nothing against him. Petitioner has clean antecedent which is evident from para 3 to this petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial
