NATH ORAL ORDER 13-05-2015 The petitioner has approached this Court earlier also in this matter in Cr. Misc. No. 38490 of 2013 and Cr. Misc. No. 19497 of 2014 which was dismissed on 03.10.2013 and on 07.05.2014 respectively.

The petitioner is in custody in connection with Sessions Trial No. 1015 of 2012 arising out of Pataliputra P.S. Case No. 216 of 2006 for the offence punishable under Sections 396 and 412 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that the prosecution witnesses have not been produced and the trial has been delayed and, therefore, the petitioner who is languishing in jail should be released on bail.

After considering the facts and circumstances of the

Patna High Court Cr.Misc. No.15988 of 2015 (2) dt.13-05-2015 case, this Court is not persuaded to take different view than earlier taken.

The prayer for bail of the petitioner is, therefore, rejected.
