JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-10-2016 As prayed for, learned counsel for the petitioner is permitted to make necessary correction in the prayer portion of the petition within course of the day.

Heard learned counsel for the petitioner and learned counsel for the Vigilance as well as learned Additional Public Prosecutor for the State.

Earlier, the prayer for bail of the petitioner was rejected by this Court but submission on behalf of the petitioner is that petitioner is in jail custody since 19.03.2016 and the record of the case of the petitioner has already been received in Vigilance Court, Patna, and moreover, cognizance of the offence in this case has already been taken and there is no likelihood of conclusion of trial of the petitioner in near future.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.46994 of 2016 (2) dt.26-10-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance ( Trap), Patna in connection with Special Case No. 16 of 2016 arising out of Vigilance P.S.Case No. 33 of 2016, subject to condition that petitioner shall appear in person before the trial court till framing of the charge and if he fails to do so, without any reasonable cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner after due and proper inquiry.
