1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Korha P.S. Case no.233 of 2019 registered under sections 302 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that on the instigation by this petitioner, her husband who happens to be the informant's brother namely, Pappu Rishi assaulted their mother leading to her death.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of family dispute. In any case of the matter, no overt act is alleged against this petitioner who is a lady and is in custody since 12.7.2023. She has no criminal antecedent.

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR, the allegation of assault being against the petitioner's husband namely Pappu Rishi, the petitioner having remained in custody for six since 12.7.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Korha P.S. Case no. 233 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
