Petitioner seeks bail in connection with Sonbarsa P.S. Case No. 129 of 2016 registered under Sections- 409, 467, 468, 471, 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that on knowing about institution of the case petitioner filed requisition for obtaining Vigilance enquiry report, which is the basis of this case, however he got the report that no enquiry report is attached with the first information report. This casts suspicion on the case. Petitioner was appointed as Shiksha Mitra on 16.05.2005. His appointment was challenged and the District

Patna High Court Cr.Misc. No.30774 of 2017 (2) dt.11-07-2017 Teachers Employment Appellate Tribunal, Sitamarhi found the employment of the petitioner to be genuine. Petitioner has already been put under suspension by the authority. Petitioner has no criminal history and is in custody since 27.03.2017. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 129 of 2016.
