Petitioners, namely, Bipin Mahato (in Cr. Misc. No. 15201 of 2015) and Kari @ Surendra Mahto (in Cr. Misc. No. 19208 of 2015) are in custody since 16.01.2015 in connection with Sonbarsa P.S. Case No. 09 of 2015 for the
Patna High Court Cr.Misc. No.15201 of 2015 (2) dt.28-05-2015 offence registered under Sections 341, 324, 326, 307 and 120B/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that though the petitioners are named in the FIR but there is no specific allegation against them. The only allegation as has been made out in the FIR is that these petitioners were part of the conspiracy as had been informed by one Kanchan Kumari. It is further submitted that similarly situated co-accused persons, namely, Shankar Mahto and Kanchan Kumari have been extended the privilege of bail by the Court below Considering the aforesaid submissions and the fact that petitioners have no criminal antecedent, let the petitioners, as mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 09 of 2015.
