The petitioner seeks bail in a case registered under Sections 304B/34 of the Indian Penal Code.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application. This is the third attempt for grant of bail filed on behalf of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.03.2014 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has remained in custody for approximately five years. The deceased is said to have committed suicide. As per the report received from the trial court, there is no chance of trial being concluded

Patna High Court CR. MISC. No.4514 of 2019(3) dt.03-04-2019 2/2 in near future. There is no eye witness to the alleged occurrnece. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. He is the husband of the deceased.

Considering the period undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned F.T.C. I, Motihari in connection with S.Tr. No.147 of 2015 arising out of Sugauli P.S. case No.72 of 2014.
