====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 25-08-2021 Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 8/20 of the N.D.P.S. Act. Mr. Manoj Kumar Singh, learned counsel for the Union of India informs the Court that out of five witnesses, only two are yet to be examined and the report of the trial Judge dated 02.08.2021 would reveal that due to COVID effect, trial could not proceed.

Now the trial Courts are partially running in physical mode. Hence considering chances of early conclusion of the trial, I am not inclined to review the order of refusal of prayer for bail as allegation is that the petitioner was apprehended

Patna High Court CR. MISC. No.12316 of 2021(3) dt.25-08-2021 2/2 along with 1 kg 800 grams of charas.

Accordingly, prayer for bail is refused in connection with N.D.P.S. Case No. 34/2018 arising out of N.C.B. Case No. 40/2018 (Tr. No. 10/2019).
