Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Buxar (Industrial) P.S. Case No. 188 of 2019 lodged under Sections 406/409/420/34 of the I.P.C.

Learned counsel for the petitioner submits that vide order dated 29.07.2021, provisional bail in this case has been granted to the petitioner on the condition that within a period of 3 months from today, the petitioner shall ensure that the entire work is completed and no dues certificate is filed before this Court. But till date, no dues certificate has not been filed either on one pretext or other.

Learned counsel for the petitioner submits that it is the duty of the petitioner to obtain no dues certificate from the official and it is not the duty of the present Court to look into those matters.

Learned counsel for the State opposes the prayer for bail In the present facts and circumstances of this case and the submissions made above, I am disposing this case with a direction that if petitioner shall produce no dues certificate/before the Trial Court, then the Trial Court shall confirm his bail but in case the said no dues certificate/completion of work certificate shall not be provided by him, in that case the provisional bail shall be cancelled/rejected.

With this observation, the bail application stands disposed off.
