Earlier prayer for bail of the petitioner was rejected by a Bench of this Court vide order dated 10.09.2012 passed in Cri. Misc. No. 21739 of 2012 directing the trial court to proceed expeditiously with the trial and avoid undue delay and adjournments.
The learned trial court has reported that the aforesaid case was committed to the court of session on 17.01.2014 after passing the order dated 10.09.2012. The trial court further reported that up till now only two prosecution witnesses could be examined and further order sheets of the record do not rteflect the receiving of the order dated 10.09.2012 passed
Patna High Court Cr.Misc. No.14719 of 2014 (4) dt.04-09-2015 2/2 in Cri. Misc. No. 21739 of 2012 nor the said order is available on the record of Sessions Trial No. 11 of 2014. Petitioner is in jail custody since 31.08.2011 and it appears that there is no possibility of conclusion of trial of the petitioner in near future.
Consider the period detention of the petitioner as well as the submission of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Adhoc A.D.J.-VII Ara in Tarari P.S.
