JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2016 Heard learned counsels for the petitioner, informant and learned counsel for the State.

The petitioner is languishing in custody since 05.03.2016 in connection with Deep Nagar P.S. Case No. 340 of 2015 for the offences instituted under Sections 363, 366(A) and 506 of the IPC. The prosecution story, in brief, is that on 22.09.2015 in the night the informant alongwith his wife, two daughters, namely, Kumkum Kumari and Madhu Kumari were sleeping in the house. In the meantime, this petitioner entered into his house and took away her daughter, namely, Kumkum Kumari, with a view to marry her. When the informant raised alarm, his room was bolted from outside and they opened the room. He narrated the story of

No.25835 of 2016 (4) dt.16-08-2016 2/2 kidnapping to the villagers and he searched his daughter but she was not found and in the next day on 23.09.2015 the informant was threatened on Mobile No. 9199889315 from Mobile Nos. 9836216218, 9534107192 and 7050962940. Hence, the F.I.R. It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.03.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. The victim girl was in love affair with Ram Naresh @ Nepali. The victim girl is said to have been recovered. She has not made any allegation of physical assault or abuse.

On behalf of the learned counsels for the informant and the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda, in connection with Deep Nagar P.S.
