The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273, 467, 468, 471, 414, 120(B) /34 of the Indian Penal Code and Section 30 (a)/38/41 of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, 18 litres foreign liquor were recovered from a Truck.

It is contended on behalf of the Economic Offence Unit that behind the petitioner's vehicle a Truck was also coming from which huge quantity of foreign liquor was recovered. However, petitioner claims that he is driver of Innova car and the owner of the vehicle was granted bail by a

Patna High Court Cr.Misc. No.35298 of 2017(2) dt.10-08-2017 2/2 co-ordinate Bench of this Court vide order dated 10.7.2017 passed in Cr. Misc. No. 31314/2017. Petitioner further claims that he is having clean antecedent and is in custody since 11.3.2017.

Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Economic Offences P.S. Case No. 05 of 2017 with further condition that one of the bailors of the petitioner should be resident of State of Bihar.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
