Petitioner seeks bail in Hawai Adda P.S. Case No.179 of 2018 instituted for the offence under Section(s) 406, 420 Indian Penal Code.

Counsel for the petitioner submits that petitioner is son of Awadhesh Prasad. He has never entered into any agreement with the informant. Agreement has been entered into between informant and his father, Awadhesh Prasad, who is Proprietor of Sri Ram Kunj Builder and Developer Pvt. Ltd. It has further been submitted that no cheque was ever issued by this petitioner. He has not received any money from the informant. Cheque has been issued by his father, which has been

Patna High Court Cr.Misc. No.5508 of 2019(2) dt.31-01-2019 2/2 enclosed with the First Information Report. Petitioner has been made accused in this case only because he is son of Awadhesh Prasad.

Petitioner is in custody since 28.10.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Patna, in connection with Hawai Adda P.S. Case No.179 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
